The Secure and Fair Enforcement for Mortgage Licensing Act (SAFE Act) of 2008 mandates a nationwide licensing and registration system for residential mortgage loan originators. The Act and its implementing regulations apply to residential mortgage loans that are used for personal, family, or household use, including re-financings, reverse mortgages, home equity lines of credit, and other first and second lien loans. Credit Unions who offer residential loan products must take specific steps to comply with this new regulation. In addition, employees who are qualified as residential mortgage loan originators have individual compliance requirements. It is the credit union’s responsibility to ensure the employee understands & complies with these mandates.
