360 Degree Advocacy for ADA Litigation Continues as Lawsuits and Demand Letters Continue

CUNA is continuing its work with league partners and credit unions as lawsuits and demand letters continue in at least 15 states. Lawsuits that we are aware of have been filed in Florida, Virginia, Pennsylvania, Ohio, Michigan, New Jersey, Georgia, Maryland, Illinois, and Texas. CUNA is currently working to prepare to file in support of litigation in all of these jurisdictions and is encouraging credit unions and leagues to keep us updated if they see any new trends or legal actions in their state. We are looking for opportunities to secure and create favorable precedent in this area for credit unions as lawsuits move through the different stages of litigation, courts, and potential appeal processes.

In addition to our legal advocacy, credit unions also continue to engage with Congress and the Department of Justice, and to work with like-minded stakeholders facing similar waves of predatory litigation alleged under the American with Disabilities Act (ADA). We are continuing our work with Members of Congress to help them understand the duress credit unions are under as a result of this predatory litigation, and the negative impact frivolous litigation has on all credit union member.
