Legislation to Combat Patent Infringement Enacted in Minnesota

The Minnesota Credit Union Network was successful in enacting legislation, H 1586, that would combat false claims of patent infringement from so-called “patent trolls.” 

Patent trolls have been known to send vague letters with meritless infringement claims to credit unions and other businesses with the intentions of extorting a settlement to avoid a troublesome lawsuit. The new law authorizes the state attorney general to investigate patent trolls and bring lawsuits against them. 

The Minnesota legislation differs from bills recently enacted in Arizona, Florida and Wyoming, because it does not give businesses targeted by patent trolls the right to sue for damages, costs, and attorneys’ fees.
